I’ve been thinking about yesterday’s post about unanimous 9-0 opinions. I think it would be interesting to see which Justices have been assigned the most 9-0 opinions either with or without concurring opinions. These numbers also include 8-0 and 7-0 decisions. With the release of several opinions this week, the Court has now released 26 opinions for the term. The Supreme Court will sit again on Monday morning for the February sitting and will likey release several opinions. As I mentioned a few weeks ago, the Court has released 5-6 opinions in the first week of its February sitting over the last few years, and we have no reason to assume they won’t release [...]

Justice Ginsburg appears to be doing well after her surgery last week. The Court released the following press release: The pancreatic cancer for which Justice Ruth Bader Ginsburg had surgery on February 5 has been determined as TNM Stage 1 by doctors at Memorial Sloan-Kettering Cancer Center in New York City. The Supreme Court is reporting that Justice Ginsburg has undergone surgery for cancer and is expected to remain in the hospital for 7-10 days.

Above the Law is reporting that Justice Souter hasn’t hired any clerks for OT09 and suggests that it may hint towards his retirement.
